GOLF CART RENTAL AGREEMENT

RELEASE, WAIVER AND INDEMNITY AGREEMENT

As consideration for the rental of the golf cart provided by Galveston Golf Cart Rentals, L.L.C., (Owner), I agree to the following conditions and hereby acknowledge the statements I make herein are true and correct. I am at least 21 years of age and hold a valid driver’s license. I acknowledge by my electronic signature below along with the electronic submission of my driver’s license and insurance information all shall become a part of this agreement and identify me as the “Renter” AND SOLE OPERATOR of the golf cart as referred to in this agreement. ALL RENTAL PERIODS ARE 1PM TO 11:00AM (22 hours), A $50/hr. FEE WILL BE CHARGE FOR LATE RETURNS AFTER 11:00AM UNTIL 12NOON. AFTER 12NOON ANOTHER NIGHT WILL BE AUTOMATICALLY ADDED TO RESERVATION.

Furthermore, I acknowledge that I own a motor vehicle with liability insurance currently in force as evidenced by the electronic submission herein.

I agree to return the cart to the location provided upon completion of the rental period in the same condition as received, normal wear and tear accepted. I will operate the cart in a safe and responsible manner and acknowledge that I have received the “Golf Cart Operating Rules and Instructions” provided by Galveston Golf Cart Rentals L.L.C. its agent(s) or designated representatives and is made a part of herein. I will preserve and protect the cart, my person or property and the persons or property of others from loss or damage. I agree to contact Galveston Golf Cart Rentals L.L.C. immediately in the event of any loss or damage to the cart, persons or personal property. I herein agree and acknowledge that I am legally and financially liable for all costs or repairs to the cart and for the loss, damage and/or injuries to my person or property and the person or property of others regardless of fault.

I agree to forever release, indemnify, hold harmless and defend Galveston Golf Cart Rentals L.L.C., its officers, successors and assigns, agents, employees or designated representatives in the event of any claim, loss, suit, demand, cause of action or any other liability whether caused directly or indirectly by Renter or any other party from the use of the cart during the Renter’s control and possession of the cart.

I agree that I am the only authorized operator of the cart and in no event shall anyone under the age of 21 without a valid drivers licence and current automobile liability insurance be permitted to operate the cart. I understand that the cart is subject to the same laws and regulations pertaining to motor vehicles and therefore agree that the cart will be operated in accordance with the laws of the State of Texas and the local laws of the City and County of Galveston. Drinking alcohol and driving the cart is against the law. I agree that I will not operate the cart at night, drive thru standing water, the surf or allow saltwater to come in contact with any mechanical or electrical part on the cart. Driving the cart on the highway is not permitted. Maximum occupancy of the cart is 6 Persons including children.

I agree that the privilege of using the cart can be revoked without notice by Galveston Golf Cart Rentals, L.L.C., in their sole discretion for any violation of this agreement, and further I agree that I shall not be entitled to any rental refund or deposit for the revocation of this agreement.

I agree that in the event the cart should become inoperable though no fault of mine, Galveston Golf Cart Rentals L.L.C. shall make reasonable efforts to repair or replace the cart. In the event the cart can not be repaired or replaced a refund will be issued for any paid portion of the rental agreement period remaining. All rental payments shall be paid in full and in advance.

By my submission of the information above, I certify that I understand and agree to the conditions set forth herein and acknowledge that I have executed this agreement voluntarily and freely and that my signature and/or electronic submission creates a contractual obligation that binds me, my heirs and all passengers.

Compliance:

Renter and any drivers of the vehicle described on the rental agreement are responsible for the following:

1. Rental Area Restriction–Per the rental instructions and map provided.

2. Unauthorized Drivers–This vehicle cannot be driven by any person other than Renter (s) listed on reservation.

3. In case of accident–Renter is held responsible for all damages if you fail to report the accident within 24 hours.

4. DWI/DUI–Renter hereby certifies that if renter or anyone else driving the vehicle is cited or convicted of driving under the influence of drugs or alcohol, that renter assumes all responsibility.

5. All parking tickets/traffic violations–are responsibility of the renter(s). Renter does hereby certify that if any tickets or traffic violations are received to notify Galveston Golf Cart Rentals, L.L.C., within 24 hours. Renter is responsible for any and all associated fees.

6. Cleaning/Deodorizing–Renter(s) will be charged if the vehicle is returned excessively dirty or with unpleasant odors. Normal beach sand is excluded from excessively dirty.

7. Vehicle Inspection–Before and after renting the vehicle, both Owner and/or their Agents and Renter(s) shall inspect the vehicle for physical damage and not any damage.

8. Seat belts–Renter(s) agree to confirm that all passengers are seated safely and belted properly before vehicle is put into motion. NO STANDING IN THE CART WHEN CART IS IN MOTION OR WHEN PARKED.

9. Child Seats–Galveston Golf Cart Rentals, L.L.C., does not supply child seats. If renter(s) wish to use own child seat, renter does so at own risk. Galveston Golf Cart Rentals, L.L.C., does not assume responsibility or liability for improper use of child seats or the passengers within the seats. It is the renter(s) responsibility to ensure proper seating for children when using this vehicle.

10. Golf Carts–Otherwise known as “Low Speed Vehicles” must not be driven over curbs, bike paths, or sidewalks. Renter(s) understand and agree tha a rented golf cart (LSV) MUST BE OPERATED BY ADHERING TO ALL NORMAL RULES OF THE ROAD BY THE STATE OF TEXAS. OFF-ROADING IS PROHIBITED especially on the beaches or dunes.

11. Right of Way–Renter(s) agree to give the right of way to faster moving traffic within safety parameters.

12. Electronic Devices–The use of earphones, air pod/earbuds, etc is prohibited when operating a golf cart (LSV). Use of mobile phone is prohibited while operating golf cart.

13. Lost, Damaged, Stolen Vehicle–Renter(s) must notify Galveston Golf Cart Rentals, L.L.C., via phone 409-497-2499, immediately within 1 hour or the incident. For medical emergencies call 911.

14. City Rules–Galveston City has stated that golf carts (LSV) must be driven on the right lane if there is a 2 lane road and seat belts must be worn at all times. No more passengers than number of seat belts.P

In the event that Galveston Golf Cart Rentals, L.L.C., is required to make a special trip charge to assist the Renter(s) with parking violations, damages, or any avoidable circumstances, Galveston Golf Cart Rentals, L.L.C., reserves the right to charge the Renter(s) a $100.00 trip charge for issues reported during business hours (8am to 5pm) and $150.00 for any issues after hours.

Cancellations: Deposit refunds require 24 hour notice; 72 hour notice required for Holidays.

Your scheduled departure date ##12##, please have the cart ready for departure at 11:00am with the key in the back seat that folds down.

RULES & OPERATING INSTRUCTIONS

1) If the golf cart is gasoline powered, start the cart turn the key to the “On” position then press the gas pedal. You may have to push the pedal all the way down to initially start the cart. If the golf cart is electric, then start the cart turn the key to the “On” position then press the accelerator pedal. ELECTRIC GOLF CARTS MUST BE PLUGGED IN EVERY NIGHT.

2)The cart will typically run for 5 or more days on a full tank of gas. DO NOT RUN THE CART OUT OF GAS. Your rental includes gas, call us if you need gas. If electric, the cart will typically run for 5 hours. CHARGE THE GOLF CART EVERY NIGHT.

3) IF THE OIL LIGHT COMES ON TURN OFF THE CART IMMEDIATELY.

4) Remove the key when cart is not in use. THERE IS A $20 LOST KEY FEE. Store the cart in a secure,safe place at night. At the end of your rental period please have the cart available at the delivery address with key in it no later than 11AM.

5) DO NOT DRIVE ON THE HIGHWAY (FM3005), YOU WILL BE TICKETED. EXTREME CAUTION SHOULD BE USED WHEN CROSSING THE HIGHWAY. Golf carts are considered vehicles and should be operated in accordance within the laws of the State of Texas and the local laws of the City and County of Galveston.

6) YOU ARE RESPONSIBLE AND LIABLE FOR ANY AND ALL DAMAGE TO THE CART, PERSONS OR PROPERTY WHILE IT IS IN YOUR POSSESSION.

7) NO UNLICENSED DRIVERS. DRIVER MUST BE 21 WITH A VALID DRIVERS LICENSE TO OPERATE THE CART, NO EXCEPTIONS!

8) NO DRIVING ON, NEAR OR OVER SAND DUNES. Carts may only be operated on areas of the beach where they are permitted. DO NOT DRIVE THRU STANDING WATER OR IN THE SURF!

9) AVOID SUDDEN OR SHARP TURNS, THIS COULD RESULT IN SERIOUS INJURY TO PASSENGERS AND/OR DAMAGE THE CART.

10) DO NOT EXCEED THE SEATING CAPACITY OF THE CART, THIS INCLUDES CHILDREN. WATCH YOUR PETS TOO. Seat belts must be worn at all times.

These rules are for your safety and enjoyment as well as the safety and enjoyment of others. Galveston Carts reserves the right to automatically charge the primary Renter(s) for damages reported and unreported by the Renter(s), using the same payment method on file. Galveston Golf Cart Rentals, L.L.C., will send an invoice to the email address it has on file with an itemized list of damages. Renter(s) will have three (3) business days to contact Galveston Golf Cart Rentals, L.L.C., to either agree to a payment or dispute the charges. In the event Renter(s) fails to contact Galveston Golf Cart Rentals, L.L.C., within three (3) business days after the notice is sent, Renter(s) will be deemed to have agreed to pay the damages using the same payment method on file.

By signing this electronic document, Renter(s) are attesting that they have read this entire agreement; including but not limited to the terms and conditions, warnings, and credit card authorization, and that they understand the agreement and agree to the agreement.
